These Terms and Conditions govern your use of the CreaturesGuard website located at https://creaturesguard.com/ (the “Website”) and any products or services offered through the Website.
By accessing or using the Website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, you must not use the Website.
These Terms may be translated into other languages, but the governing language is English in the event of any contradiction in terms between the English and foreign translations.
Definitions
Website | refers to https://creaturesguard.com/ and all associated pages and services offered therein.
User | refers to any individual accessing or using the Website.
Content | refers to any digital 3D models, images, text, graphics, videos, or other materials available on the Website.
Products | refers to digital 3D models available for purchase or download (including free Products) on the Website.
Model | refers to a single Product (3D model or digital asset) made available on the Website, whether paid or free.
Ownership
CreaturesGuard retains all rights, title, and interest in and to the Website, including all Content and Products available therein.
Users acknowledge that they do not acquire any ownership rights by purchasing, downloading, or using the Products. Purchasing or downloading a Product grants a license only, as described below and in the CreaturesGuard End User License Agreement (“EULA”).
License Rights
CreaturesGuard grants Users a limited, non-exclusive, non-transferable, non-sublicensable license to use purchased or downloaded Products strictly in accordance with the CreaturesGuard End User License Agreement (EULA), available at https://creaturesguard.com/end-user-license-agreement-eula and incorporated into these Terms and Conditions by reference.
Users may not sublicense, redistribute, resell, or re-upload the Products, in their original or modified form, except as expressly permitted under the EULA.
Intellectual Property Rights
All Content and Products available on the Website are protected by copyright, trademark, and other intellectual property laws, and remain the property of CreaturesGuard or its contributing artists at all times.
Usage Rights and License Types
CreaturesGuard offers Products under the following license types, each governed in full by the CreaturesGuard End User License Agreement (EULA):
- Standard License (Paid Products): Users may use the Model in their own personal or commercial end-use projects (e.g., games, films, animations, renders, personal 3D prints). Resale, redistribution, re-upload, or sublicensing of the Model itself is strictly prohibited under all circumstances.
- Free License (Free Products): Users may use the Model strictly for personal, non-commercial purposes only. Commercial use, resale, redistribution, or re-upload of the Model is strictly prohibited unless separate written permission is obtained from CreaturesGuard.
CreaturesGuard does not offer a resale, distribution, or sublicensing license for any Product. No license tier granted by CreaturesGuard permits a User to resell, redistribute, or re-upload a Model, whether in original, modified, or converted form, under any circumstance. See the EULA for the complete list of prohibited uses and permitted showcasing rules.
Users must adhere to the usage restrictions outlined in the EULA and may not exceed the scope of the license granted.
Compliance with Laws
Users agree to use the Website, Content, and Products in compliance with all applicable laws, regulations, and third-party rights.
Users are solely responsible for obtaining any necessary licenses, permissions, or clearances for their use of the Products.
Termination of Rights
CreaturesGuard reserves the right to terminate or revoke any User’s license to use the Products immediately, without refund, if they violate these Terms and Conditions, the EULA, or any applicable laws — including any unauthorized resale, redistribution, re-upload, or misattribution of a Model.
Upon termination, Users must immediately cease all use of the Products and destroy any copies of the Products in their possession.
Reservation of Rights
CreaturesGuard reserves all rights not expressly granted to Users under these Terms and Conditions and the EULA.
CreaturesGuard may enforce its rights and remedies under these Terms and Conditions and the EULA to the fullest extent permitted by law, including issuing takedown notices and pursuing legal action against unauthorized resale or redistribution.
Modification of Rights
CreaturesGuard reserves the right to modify or update the rights granted to Users, the EULA, or these Terms and Conditions at any time. Material changes will be posted on the Website with a revised effective date.
Users are bound by the rights and licenses in effect at the time of their purchase and use of the Products, except where a Terms or EULA update is required for legal compliance.
License to Use
Upon purchase or download, CreaturesGuard grants the User a limited, non-exclusive, non-transferable license to use the Product strictly in accordance with the applicable license type (Standard License or Free License) and the full terms of the CreaturesGuard End User License Agreement (EULA), which governs all permitted and prohibited uses, including resale, redistribution, showcasing, and attribution requirements.
A summary of the two license types is provided below; the EULA is the controlling document in the event of any conflict.
Standard License (Paid Products)
The Standard License grants the User the right to use the purchased Product in personal and commercial end-use projects for an unlimited period of time, subject to the following restrictions:
- The User may not resell, redistribute, re-upload, or sublicense the Product, in its original or modified form, under any circumstance.
- The User may not claim ownership or authorship of the Product.
- The User may not extract, isolate, or repackage individual components (textures, rigs, meshes) of the Product for separate distribution.
Free License (Free Products)
The Free License grants the User limited usage rights for personal, non-commercial projects only. Subject to the following restrictions:
- The User may not use the Product for any commercial purpose, including paid commissions, monetized content, or inclusion in a product offered for sale, without separate written permission from CreaturesGuard.
- The User may not redistribute, resell, re-upload, or sublicense the Product in its original or modified form.
- The User may not claim ownership or authorship of the Product.
Limitation of Liability
CreaturesGuard shall not be liable for any damages arising out of the use or inability to use the Products or Content available on the Website. In no event shall CreaturesGuard be liable for any direct, indirect, incidental, special, or consequential damages.
Governing Law
These Terms and Conditions and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the jurisdiction of Pakistan, without regard to its conflict of law provisions.
Jurisdiction
Any legal action or proceeding arising out of these Terms and Conditions or the use of the CreaturesGuard Website shall be brought exclusively in the courts of the jurisdiction of Pakistan.
Users consent to the exclusive jurisdiction and venue of such courts and waive any objection to the laying of venue in any such proceeding.
Arbitration
CreaturesGuard may, at its sole discretion, require any disputes or claims arising out of these Terms and Conditions or the use of the Website to be resolved through binding arbitration.
The arbitration shall be conducted by a single arbitrator in accordance with the rules of arbitration of the jurisdiction of Pakistan, and the decision of the arbitrator shall be final and binding on all parties.
Class Action Waiver
Users agree that any arbitration or legal proceedings shall be conducted on an individual basis and not as a class, consolidated, or representative action.
Users waive any right to participate in a class action lawsuit or class-wide arbitration.
Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid under applicable law, the remaining provisions shall continue in full force and effect.
Waiver
The failure of CreaturesGuard to enforce any right or provision of these Terms and Conditions shall not be deemed a waiver of such right or provision.
Entire Agreement
These Terms and Conditions, together with the CreaturesGuard End User License Agreement (EULA) and Privacy Policy, constitute the entire agreement between Users and CreaturesGuard regarding the use of the Website and supersede any prior agreements or understandings, whether written or oral.
