This End User License Agreement (“Agreement”) is a binding agreement between CreaturesGuard (“Licensor,””we,””us”) and any individual or entity that downloads, purchases, or otherwise obtains a 3D model or digital asset (“Model”) from creaturesguard.com (the “Site”) (“Licensee,””you”). By downloading, purchasing, or using a Model, you agree to be bound by this Agreement.
1. Grant of License
Subject to your compliance with this Agreement, Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Model as follows:
- Paid Models (Standard License): you may use the Model in your own personal or commercial end-use projects, including games, films, animations, renders, 3D prints for your own use, and similar finished works.
- Free Models: you may use the Model strictly for personal, non-commercial purposes only, unless separate written permission is obtained from Licensor for commercial use.
No other rights are granted except as expressly stated in this Agreement. All rights not expressly granted are reserved by Licensor.
2. Ownership
The Model, including all associated meshes, textures, materials, rigs, and source files, remains the sole intellectual property of Licensor (or its contributing artists). This Agreement is a license, not a sale or transfer of ownership or copyright, of the Model itself.
3. Prohibited Uses
Regardless of whether a Model was purchased or obtained for free, you may NOT, under any circumstance:
- Resell, sublicense, rent, lease, or otherwise distribute the Model (in original, modified, converted, or re-exported form) as a standalone asset, on any marketplace, storefront, platform, or file-sharing service.
- Re-upload, mirror, or share the Model’s source or exported files (e.g., .blend, .fbx, .obj, .stl, .3mf, textures) for others to download, whether for free or for payment.
- Claim authorship or original creation of the Model, or present it as your own work, on any portfolio, profile, social media page, or commercial listing.
- Showcase, publish, or repost the Model (renders, turnarounds, or the files themselves) without clear and visible credit to CreaturesGuard as the original creator, where showcasing is otherwise permitted under Section 4.
- Use a Free Model for any commercial purpose, including paid commissions, monetized content, or inclusion in a product offered for sale, without separate written permission.
- Extract, isolate, or repackage individual components (textures, rigs, meshes) of the Model for separate distribution.
4. Permitted Showcasing
You may display finished works that include the Model (e.g., a rendered scene, an animation, a game featuring the Model) in your portfolio, social media, or promotional materials, provided that:
- The Model is not the sole or primary subject of a listing offered for sale or download (i.e., you are not effectively reselling or redistributing the raw asset by showcasing it).
- Reasonable credit to “CreaturesGuard” is included where the platform allows for it (e.g., a caption or description credit).
- The showcase does not imply that you created the Model or that you are authorized to distribute it further.
5. Enforcement and Remedies
Any violation of Section 3 constitutes a material breach of this Agreement and an infringement of Licensor’s copyright. Licensor reserves the right to:
- Terminate your license immediately upon breach, without refund.
- Issue takedown notices (including DMCA or platform-specific IP claims) against any unauthorized listing, upload, or repost.
- Pursue any other remedy available at law or equity, including damages and injunctive relief.
6. No Warranty
Models are provided “as is.” Licensor makes no warranty regarding fitness for a particular purpose, and is not liable for any indirect, incidental, or consequential damages arising from use of a Model.
7. Termination
This license terminates automatically if you breach any term of this Agreement. Upon termination, you must immediately cease all use of the Model and destroy all copies in your possession.
